The Election Commission of India (ECI) on Sunday reminded media outlets and broadcasters to strictly adhere to the provisions of the Representation of the People Act, 1951 regarding the prohibition of election-related content during the mandated silence period ahead of polling for the Bihar Assembly elections and bye-elections.
Polling for the Bihar Assembly will be held in two phases — on November 6 and November 11.
Under Section 126(1)(b) of the Act, displaying any election matter by means of television, radio, or similar media in a polling area is prohibited during the 48-hour period ending with the close of polling. The ECI said TV and radio channels, as well as cable networks, must ensure that programmes aired during this time do not contain material — including views or appeals by panellists — that could be construed as promoting or prejudicing the prospects of any party or candidate.
The Commission also reiterated that displaying opinion polls during this period is strictly barred.
In a related directive, the ECI invoked Section 126A of the Act to prohibit the conduct and dissemination of exit polls between 7:00 AM on November 6 and 6:30 PM on November 11, covering the entire polling duration across both phases.
The Commission warned that violations of these provisions are punishable with imprisonment for up to two years, or with fine, or both.
Emphasising fair and ethical coverage, the ECI urged all media houses to abide by these restrictions “in letter and spirit” to ensure a free, transparent, and peaceful electoral process.
